General Misconduct

ECU students are expected to abide by the Student Code of Conduct at all times and demonstrate behaviour that is consistent with ECU values of Integrity, Respect, Rational Inquiry, Personal Excellence and Courage.

ECU prides itself on ensuring a safe and harmonious learning environment for all students. Sometimes, student behaviour does not align with the Student Code of Conduct or ECU Values and could be considered a breach of the University’s General Misconduct Rules (Students).

Actions that may be considered under the General Misconduct Rules include but are not limited to:

  • Submitting fraudulent medical certificates
  • Misuse of university technology
  • Harassment or bullying
  • Disruptions to the learning environment
  • Damage to property
  • Sexual harassment and assault

The General Misconduct process for students at Edith Cowan University involves these key steps:

  1. Reporting: Misconduct allegations are reported to an Officer or Senior Officer. Staff must report within 14 days of noticing the issue.
  2. Investigation: The Officer or Senior Officer starts an investigation within 14 days, following fair procedures and avoiding conflicts of interest.
  3. Notification and Response: The student is notified in writing about the allegation and has 14 days to respond or request an interview.
  4. Interview: If requested, an interview is arranged. The student can have a representative present to support them. The interview is the students chance to explain the situation and for the officer to understand their circumstances.
  5. Decision: The Officer decides if misconduct occurred and the consequences, considering various factors like the student’s history and the impact on their studies.
  6. Appeal: Students can appeal the decision within 30 days on grounds like bias, procedural errors, or excessive outcomes.
  7. Appeal Committee: Appeals are handled by the General Misconduct Appeals Committee, ensuring a fair hearing and decision-making process.

This procedure ensures fairness and transparency in addressing student misconduct, offering chances for students to respond and appeal.

Reporting General Misconduct

Reporting General Misconduct can be initiated by staff members, students or members of the public.

Reports can be made via the Reporting General Misconduct by ECU Students form. Reports can be made anonymously.

Alternative pathways for reporting concerns

General Misconduct is different to Academic Misconduct, which is specifically about inappropriate or unethical academic behaviour.  There is also a specific process for reporting  incidents of sexual harassment or sexual assault.

ECU also has policies and procedures for a wide range of complaints, grievances, misconduct concerns and safety incidents. This includes personal safety, modern slavery concerns and welfare concerns.

The university also has a Fitness to Study policy that supports students who may need additional assistance or to be asked to take a break from studying.
