Human research policy and legislation

Ethical conduct of research activities that involves human participants is governed by guidelines contained in legislation and policies.

National Health and Medical Research Council (NHMRC)

Australian Code for the Responsible Conduct of Research

This Code guides institutions and researchers in responsible research practices. It promotes integrity in research and explains what is expected of researchers by the community.

The Code advocates and describes best practice in research, as well as setting out a framework for handling breaches. Advice is provided on how to manage research data and materials; how to publish and disseminate research findings (including proper attribution of authorship); obligations in peer review; how to collaborate across institutions; and how to manage conflicts of interest.

National Statement on Ethical Conduct in Human Research 2023

The National Statement promotes ethically good human research and ensures that research participants are accorded the respect and protection that is due to them.  The Statement is designed to clarify the responsibilities of:

  • institutions and researchers for the ethical design, conduct and dissemination of results of human research; and
  • review bodies in the ethical review of research.

Values and Ethics: Guidelines for Ethical Conduct in Aboriginal and Torres Strait Islander Health Research

This document contains guidelines for ethical health research on Aboriginal and Torres Strait Islander peoples and is written around a framework of Aboriginal and Torres Strait Islander values and principles.

Guidelines under Section 95 of the Privacy Act 1988

These guidelines set the current standard for the protection of privacy in the conduct of medical research involving human participants in Australia.

Guidelines approved under Section 95A of the Privacy Act 1988

These guidelines provide a framework to ensure privacy protection of health information that is collected, used or disclosed in the conduct of research and the compilation or analysis of statistics, relevant to public health or public safety, and in the conduct of health service management activities.
